Petitioner seeks bail in connection Alauli P.S. Case no. 17 of 2020 registered for the offence punishable under section 392 Indian Penal Code.
Learned counsel for the petitioner submits that the informant in the FIR has alleged that on 21.01.2020 at 9 p.m, his nephews Abhinav Kumar and Pappu Kumar left for Alauli to see off his brother-in-law and further on the way they were accosted by three accused and snatched motorcycle of nephew of the informant. Further nephew of the informant identified all three accused including this petitioner. Learned counsel for the petitioner further submits that co-accused Rohit Yadav @ Rohit Kumar has been granted bail by order dated 16.12.2020 in Cr. Misc. no.
Patna High Court CR. MISC. No.32317 of 2021(3) dt.30-11-2021 2/2 33532/2020 and Prabin Ray @ Pravin Kumar vide order dated 15.9.2020 in Cr. Misc. no. 23409/2020. He further submits that petitioner is similarly situated like the aforesaid two accused persons only different is with respect to antecedent, this petitioner has 11 antecedent, Rohit Yadav has 05 antecedent and Prabin Ray has one antecedent.
Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody since 01.05.2020 and charge sheet has been submitted and co-accused have been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Judicial Magistrate, Ist Class, Khagaria in Alauli P.S. Case no. 17 of 2020 with condition that till trial does not commence petitioner would mark his attendance on 15th of every month in the concerned police station commencing from December, 2021, in the event, it is reported by the police station to the learned court below that petitioner on any of 15th of any of the month has not marked his attendance in the police station then the learned court below would be at liberty to cancel his bail bond.
