JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being mother in law of the informant apprehends her arrest in connection with Mahila Nawada P.S. Case No. 27 of 2014 registered for the offences punishable under Sections 498A, 323, 341, 504, 380/34 of the Indian Penal Code. It would appear from perusal of the record that the marriage of informant was solemnized in the year 2000 and the present case was lodged in the year 2014. Moreover, much prior to filing of the present case, the husband of the informant has already filed a divorce suit.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/

Patna High Court Cr.Misc. No.1499 of 2015 (2) dt.15-01-2015 surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Nawada in Mahila Nawada P.S. Case No. 27 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
