The petitioner apprehends her arrest in Sakari P.S. Case No. 128 of 2012, registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code. The informant made allegation that on 22.08.2012, Shabnum Praveen, the petitioner took his daughter Husnbano @ Sajra, but she did not return. When the informant made enquiry from Shabunam Praveen, Shabunam Praveen disclosed that his daughter has already left her house. The informant alleged that Shabunam Praveen and others kidnapped his daughter. Learned counsel for the petitioner submits that the police after investigation submitted final form finding the case false. The victim was married to Ishtiyaq. The victim disclosed that Shabunam Praveen took her to Delhi and on such the court

Patna High Court Cr.Misc. No.1107 of 2015 (2) dt.12-01-2015 below took cognizance against the petitioner. It appears that the victim has already married with Ishtiyaq as she disclosed in her statement made under Section 164 of the Cr.P.C. The victim appears to be major. Considering the facts aforesaid, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarge on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri M.K. Srivastava, the learned Judicial Magistrate, Ist Class, Madhubani in connection with Sakari P.S. Case No. 128 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
