JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Again, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 354 of 2015 arising out of Motihari Rail P.S. Case No. 07 of 2015 pending in the court of 2nd Additional Sessions Judge, Bettiah, West Champaran stands rejected.
However, the concerned court should expedite the trial of the petitioner and try to conclude the same as early as possible,
Patna High Court Cr.Misc. No.47216 of 2016 (3) dt.29-03-2017 2/2 preferably within the period as fixed by the learned trial court itself vide its report dated 15.03.2017.
