JUSTICE SATYAVRAT VERMA ORAL ORDER 28-01-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in connection with Excise Case No.93 of 2020, instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act. The learned counsel for the petitioners submits that the petitioners are in custody since 24.10.2020, they are persons with clean antecedent and prosecution report has been submitted.

Allegation is of recovery of 3096 litre of liquor from a truck.

The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.32546 of 2021(4) dt.28-01-2022 2/2 petitioners are driver and cleaner of the truck and as such, were not aware what was loaded in the truck by the owner of the truck.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody since 24.10.2020, they are persons with clean antecedent and prosecution report has been submitted, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special Judge, Excise, Bhagalpur in connection with Excise P. S. Case No.93 of 2020.

The application stands allowed.
