JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 448, 341, 323, 354 of the Indian Penal Code and Section 3(1)(x) of the SC/ST Act.
It is alleged that in the night the petitioner caught hold of the informant and tried to outrage her modesty resulting into altercation.
Learned counsel for the petitioner submits that the incident took place inside the house and as such no case under section 3(1)(x) of the SC/ST Act is made out. He further submits that comprise has been arrived at between the parties. Learned counsel for the State opposes the prayer for bail and submits that the petitioner tried to outrage the modesty of the informant.
Patna High Court Cr.Misc. No.50601 of 2015 (3) dt.22-12-2015 Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. His prayer for anticipatory bail is rejected. However, if the petitioner surrenders within four weeks from today and pray for regular bail, the same would be disposed of on its own merit and also taking into consideration the compromise petition.
