JUSTICE PRABHAT KUMAR JHA ORAL ORDER 10-03-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State as well as learned counsel for the complainant. The petitioner apprehends his arrest in a case under Section 498A and other sections of the Indian Penal Code. The petitioner is the husband. The wife is also present in court. Wife made allegation of demand of dowry and torture. She also alleged that her husband solemnized second marriage with one Sajni Devi of Village Narahiya. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife. His wife was also ready to compromise the case.
The learned counsel for the complainant submitted that the wife has got two children from the petitioner. Thereafter,
Patna High Court Cr.Misc. No.408 of 2015 (3) dt.10-03-2015 2/2 the petitioner solemnized the second marriage and the petitioner has got three children from his second wife.
Having considered the fact that the petitioner not only deserted his wife and children but solemnized the second marriage and the case was lodged in the year 2007 and after eight years of the occurrence, the petitioner has come to this Court, I am not inclined to enlarge the petitioner on anticipatory bail in C.R. No. 166/2007 corresponding to T.R. No. 665/2013. Accordingly, the same is rejected.
