Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 302/34/120B of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., 8 persons indiscriminately fired at Mantu causing his death.

Learned counsel for the petitioner submits that the post mortem report would reveal that only two wounds of entry and corresponding wounds of exit were found on the person of the deceased. In the circumstance, chances of over implication due to enmity cannot be completely ruled out. Petitioner is in

Patna High Court CR. MISC. No.22762 of 2020(4) dt.26-07-2021 2/2 custody since 07.08.2019. Investigation of the case is already complete.

Considering the general and omnibus nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No. 461 of 2019 arising out of Tajpur (Waini) P.S. Case No. 107 of 2015, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
