JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406, 420, 467, 468, 471 and some other ancillary Sections of the Indian Penal Code.

It is submitted on behalf of the petitioner that out of the total alleged amount of Rs. 24,90,000/- the petitioner is ready to refund the admitted amount of Rs. 12,50,000/- to the informant in installments. Rest of the amount has been disputed by the petitioner.

In view of aforesaid submission, let the petitioner, above named, in the event of his arrest/ surrender within a

Patna High Court CR. MISC. No.23781 of 2022(3) dt.13-07-2023 2/2 period of eight weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar PS case No.857/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. with further condition that at the time of furnishing bail the petitioner shall refund Rs. 5,00,000/- (five lacs) to the informant through demand draft and remaining amount of Rs. 7,50,000/- shall be returned to the informant through demand draft in three installments within a period of six months, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
