The petitioner seeks regular bail in Hussainganj P.S. Case No. 250/2018, registered for the offences punishable under Section 392 of the Indian Penal Code. Later on, section 411 of the Indian Penal Code was added.

Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R. There is no recovery from his possession. No test identification parade has been held. He has been apprehended on mere suspicion and thereafter, the police has recorded his confessional statement. He is in custody since 08.08.2018 having clean antecedent. Other co-accused has been granted bail by this court vide order dated 05.11.2018 passed in Cr. Misc. No. 64996/2018.

Patna High Court Cr.Misc. No.73250 of 2018(2) dt.10-12-2018 2/2 Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 250/2018.
