JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 23.06.2020, within four weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
The petitioner seeks bail in connection with Maner P.S. Case No. 255 of 2019, registered under Section 304(B)/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that, earlier, the bail prayer of the petitioner, who is
Patna High Court CR. MISC. No.21093 of 2020(2 ) dt.07-07-2020 2/2 husband of deceased, was rejected vide Criminal Miscellaneous No. 74420 of 2019 on 18.12.2019. Further submission is that after commitment of the case, five prosecution witnesses, including the informant, have been examined, but none have supported the prosecution case. The petitioner is in custody since 21.06.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-VII, Danapur, Patna in connection with Maner P.S. Case No. 255 of 2019.
