This application for grant of anticipatory bail arises out of Tandwa P.S. Case No. 90 of 2020, registered for the offence under Section 30(A) of the Bihar Prohibition & Excise Act, 2016.

It is contended by the petitioner that he had sold the motorcycle to one Sukhari, Rai, father of the Rupesh Rai, who was arrested with liquor.

Considering the aforesaid fact, the application for anticipatory bail is allowed till submission of charge-sheet. Let the petitioner, named above, in the event of his

No.33429 of 2021(2) dt.10-12-2021 2/2 arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge, Excise, Aurangabad (Bihar) in connection with Tandwa P.S. Case No. 90 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

After being released on anticipatory bail, the petitioner will join the investigation and if the Investigating Officer finds that the motorcycle was not sold by the petitioner and a forged document has been created by him just to take bail then the bail granted to him shall be cancelled.
