Petitioner seeks regular bail in connection with Ghorasahan P.S. Case No. 392 of 2020 registered for the offence under Section 394 of the I.P.C.

Four miscreants tried to stop the motorcycle of the informant but the informant changed his route but on the point of knife the vehicle was stopped, the sister of the informant fell down and two of the miscreants fled away with "mangalshutra" and purse of the sister of the informant however two miscreants namely, Mukesh Prasad and Abdul Karim were apprehended by the local villagers, who disclosed the name of the petitioner and one another accused Ranjan Sah.

Learned counsel for the petitioner submits that the name of the petitioner transpired on the basis of the statement made by the accused persons who were apprehended by the local people and no incriminating material and / or looted article has been recovered from his possession. Patna High Court CR. MISC. No.32266 of 2021(2) dt.16-12-2021 2/2 been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 13491 of 2021 (Abdul Karim vs. The State of Bihar) & Cr. Misc. No. 13447 of 2021 (Mukesh Prasad vs. The State of Bihar) and the petitioner is in custody since 05/02/2021. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that similarly situated accused persons have been granted bail by a Co-ordinate Bench of this Court, as such, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIII Sikrahana at Dhaka, District-East Champaran in connection with Ghorasahan P.S. Case No. 392 of 2020.
