JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Doriganj P.S.Case No. 251 of 2017 registered under Sections 147, 148, 149, 188, 307, 332, 341, 353, 383 and 120B of the Indian Penal Code.

Earlier prayer for anticipatory bail of the petitioner was allowed vide order dated 20.06.2018 passed in Cr. Misc. No. 21913 of 2018 with condition to surrender within a period fo six weeks.

Submission of learned counsel for the petitioner is that due to unavoidable circumstances, he could not surrender and as such he has filed the present modification application. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.76612 of 2018(2) dt.20-12-2018 2/2 circumstances, as stated above, I am not inclined to interfere with the earlier order passed by this Court. However, if petitioner surrenders and makes prayer for regular bail, the same shall be considered on its own merit and considering that earlier prayer for anticipatory bail of the petitioner was allowed but he could not surrender within time.
