JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2019 This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No. 102 of 2018, disclosing offences under Sections 448, 341, 323, 324, 354, 376, 511 of the Indian Penal Code.

Allegation against the petitioner is that he entered in inside the house of the informant caught hold her and tried to commit rape upon her and on Hulla, the petitioner assaulted her by knife causing injury on her hand.

Submission of learned counsel for the petitioner is that there was a Title Suit between the father-in-law of the informant and the wife of the petitioner and that has been decided in favour of the petitioner and thereafter the appeal is pending and due to that the present case has been lodged against the petitioner.

Patna High Court CR. MISC. No.77416 of 2018(3) dt.12-04-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioner on the ground that the father-in-law of the informant is living separately and as such, the informant has no knowledge about the Title Suit.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada, in connection with Muffasil P.S. Case No. 102 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
