The petitioner seeks regular bail in connection with Suiya P.S. Case No. 36 of 2018, registered for the offence punishable under Sections 147, 149, 328 and 302 of the Indian Penal Code.
The allegation is regarding the accused persons including the husband of the deceased victim lady having killed the daughter of the informant on account of family dispute.
The learned counsel for the petitioner submits that a bare perusal of the FIR would show that the husband and wife were living separately in Tata and as far as the petitioner is concerned, he being the brother-in-law of the deceased victim lady, he has got nothing to do with the alleged incident
Patna High Court CR. MISC. No.29381 of 2019(7) dt.06-12-2019 2/2 and a general and omnibus allegation has been levelled against him by the informant. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 20.9.2018. Lastly, it is submitted that similarly co-accused persons including in-laws of the deceased victim lady have been granted bail by a coordinate Bench of this Court vide order dated 29.3.2019 passed in Criminal Miscellaneous No. 4052 of 2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1, Banka in connection with S.T. No. 14 of 2019 arising out of Suiya P.S. Case No. 36 of 2018.
The registry is directed to seal the FSL report and return the same to the learned court below.
