====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 09-05-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offence under Sections 376,341,323,504,506 and 34 of IPC and Section 4 of D.P.Act.

As per FIR, the petitioner carry specific allegation for committing sexual assault and harassment with the victim prosecution since year 2015 in pretext of solemnizing marriage and subsequently in spite of several requests and efforts of the prosecutrix and her parental family members, the petitioner family denied to solemnize marriage with prosecutrix on being in collusion and connivance with co-accused who all started demanding dowry of cash of Rs.Five Lacs, motorcycle, golden chain and other articles for solemnizing marriage and finally on

Patna High Court CR. MISC. No.37763 of 2021(8) dt.09-05-2022 2/2 dated 18.05.2020 the accused persons including the petitioner again refused the decision of panchayat and other co-villagers to solemnize marriage with prosecutrix and has also assaulted to informant's family members.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. Vide order dated 28.02.2022, a report was called for with regard to the stage of the trial. Report reveals that all the prosecution witnesses have already been examined and the case is fixed for argument.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Araria Mahila P.S.Case No.55 of 2020 pending in the court of learned S.D.J.M., Araria.

Prayer is refused.

The learned Trial Court is directed to expedite the trial and conclude the same as early as possible.
