JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Main P.S. Case No. 24 of 2016 registered under Section 387/34 of the Indian Penal Code, Section 25(1-b)A, 26 and 35 of the Arms Act and Section 17 of the C.L.A. Act.

The accusation is of recovery of 10 cartridges of 315 bore and 4 cartridges of 303 bore from possession of the petitioner.

Learned counsel for the petitioner submits that petitioner is in custody since 15.06.2016. Further submission is that while petitioner is accused in two other cases, but in both cases, he is on bail.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.1097 of 2017 (2) dt.13-01-2017 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Main P.S. Case No. 24 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
