JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 468/34 of the Indian Penal Code.

The prosecution case is that on the basis of fabricated oral deed alleged to be executed by the father of the informant, the petitioner tried to disturb the peaceful possession of the informant.

It is submitted by learned counsel for the petitioner that concerned alleged deed is under challenge in Title Suit No. 429 of 2014 but subsequently for a civil nature of dispute, the present F.I.R has been lodged.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.44178 of 2015 (2) dt.29-10-2015 2/2 before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Chapra in connection with Mashrakh P.S. Case No. 92 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
