JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-10-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Chanan P.S. Case No.119 of 2019 for the offence under Section 302/34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 17, 18, 20 and 23 of the Unlawful Activities (Prevention) Act, 1967.

Learned counsel for the petitioner submits that there is no specific allegation of firing against the petitioner and he is in custody on remand since 17.10.2019.

Learned counsel appearing on behalf of the State would submit that it would not be appropriate to release the petitioner having criminal antecedents as release of the

Considering the aforesaid, the application for grant of bail is disposed of with a direction to the Additional Chief Judicial Magistrate 1st, Lakhisarai to release the petitioner on bail on appropriate terms and conditions after result of General Election in the State of Bihar is declared i.e. after 10th November, 2020.
