Heard learned counsel for the parties.

This application for grant of regular bail arises out of Rail Kiul P.S. case No. 25 of 2020, disclosing offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 24.02.2020. Petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 19.08.2020 passed in Cr. Misc. No. 19632 of 2020 with liberty to him to renew his prayer for bail after six months, if, in the meanwhile, charges are not framed. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.33792 of 2021(2) dt.04-08-2021 2/2 till the date of the filing of the application, charges have not been framed. There is allegation against the petitioner of having been found in possession of huge quantity of illicit liquor and during the course of investigation, he disclosed his involvement in illicit trade of liquor.

Considering the petitioner's custody and this Court's observation made in the order dated 19.08.2020 passed in Cr. Misc. No. 19632 of 2020, whereby petitioner's prayer for regular bail was earlier rejected, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge, Excise, Lakhisarai in Rail Kiul P.S. Case No. 25 of 2020.
