2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 317(2) of the BNS, 2023 and under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, altogether 261 litres of illicit foreign liquor has been recovered from a motorcycle and an Alto car.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. No incriminating article has been recovered either from the conscious possession of the petitioner or from his house.

5. Learned APP for the State has opposed the bail petition and submits that altogether 261 litres of foreign liqour has been recovered from the vehicles in question and as per paragraph no. 3 of the bail petition, petitioner carries two criminal antecedents of similar nature.

6. Considering the fact that petitioner carries two criminal antecedents of similar nature, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Shahnawaz/- U T
