On the facts of the case, the submission that the case may not fall within the purview of Section 420 of the Indian Penal Code could not be upheld. The issuance of cheques for settling the account as regards the repayment of Rs. 5,65,000/- to the complainant and the cheques bouncing back on presentation before the payee bank, in my opinion could be a cut and dried example of an offence under Section 420 of the Indian Penal Code.
