Petitioner, Uday Singh, is in custody since 17.05.2016 in Vishnupad P.S. Case No. 77 of 2016 registered under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act. 3.
According to prosecution case, from two accused persons, 122 bottles of English wine were recovered and they confessed that the petitioner is also their co-associates.

Learned counsel for the petitioner submitted that from the possession of the petitioner, nothing has been recovered. He himself has surrendered before the Court. The co-accused confessed wherein they named the petitioner. Except this allegation, there is nothing to implicate this petitioner in the present case. 5.
Considering the above facts and circumstances and the
Patna High Court Cr.Misc. No.38953 of 2016 (2) dt.17-09-2016 fact that the petitioner himself had surrendered and the period of detention, I direct the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 77 of 2016.
