JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 Petitioner prays for bail in connection with Special Case No. 11 of 2018/CIS 11 of 2018, arising out of Dagarwa P.S.Case No. 138 of 2018 registered for the offences punishable under Sections 8, 20(b)(ii)(c) and 25 of N.D.P.S. Act. Allegation is of recovery of 50 kg. of ganja from the vehicle and petitioner was arrested there.

Submission of learned counsel for the petitioner is that he is only a passenger and nothing has been recovered from his conscious possession and he is in custody since 14.7.2018, having no criminal antecedent.

Heard learned APP also.

Having heard both sides and in view of recovery of huge quantity of ganja, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

With the above observation, this application is dismissed.
