The petitioner apprehends his arrest in Mahua P.S. Case No. 109 of 2013, registered for the offences punishable under Sections 384 and 386 of the Indian Penal Code. Subodh Rai the informant named Kundan Singh and Pintu Mishra and alleged that they snatched his motorcycle bearing Registration No. BR06AD 3666.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of co-accused and in pursuance thereof one TVS Star motorcycle is said to have been recovered.

It appears that TVS Star motorcycle is alleged to have been recovered from the hut of the petitioner which is not

Patna High Court Cr.Misc. No.364 of 2015 (2) dt.07-01-2015 looted one.

Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 109 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
