Petitioner has asked for to deal with the contemners under the guise of Contempt of Court Act on account of failure at their part in compliance of order dated 23.09.1999 passed under CWJC No.10219 of 1996 (Annexure-3). From para-7 of the judgment impugned, it is evident that the respondents were directed to release the retrial benefits in favour of petitioner within two months from the date of production/receipt of the order impugned, failing which penal interest at a rate of 10% per annum was directed to be charged thereupon. From the contents of petition, it is evident that aforesaid order has been availed of however, the payment is found having dissatisfaction at the end of petitioner on account of certain curtailment in the background of finding of the departmental proceeding, in terms of Rule-43(b) of the Bihar Pension Rules, 1950 which would certainly be a different cause and for that, petitioner is directed so. Long absence of petitioner also suggest like so.

Accordingly, petition is rejected.
