The petitioner has prayed for bail in connection with Bettiah Town P.S. Case No. 834 of 2017 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, on a secret information, a raid was conducted in under-construction house. The informant and other police personnel managed to catch hold of one person, who was found to be having five litres of country made liquor and it transpired that the same house belongs to this petitioner. It is submitted by learned counsel for the petitioner that except the confessional statement of co-accused, there is no

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that petitioner is in custody since 08.02.2018, this court is inclined to enlarge him on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Bettiah Town P.S.
