JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Baikunthpur P.S.Case No. 258 of 2018 registered under Section 30(a) 32(b) (ii), 38(i) and 41 of the Bihar Prohibition and Excise Act, 2016 . Allegation as per the FIR is that the police apprehended a Bolero vehicle and recovered liquor and apprehended one person. It is alleged that petitioner being a Sub Inspector allowed the accused to leave the place and release the vehicle. Submission of learned counsel for the petitioner is that the FIR itself shows that on the order of the Officer-in-charge, vehicle was released and petitioner has falsely been implicated in this case and petitioner is in custody since 03.10.2018 and Officer-in-charge has already been granted bail by a co-ordinate Bench of this Court vide order dated 06.12.2018 passed in Cr. Misc. No. 72591 of 2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Gopalganj in connection with Baikunthpur P.S.Case No. 258 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
