The petitioner seeks bail in Nalanda P.S. Case No. 171 of 2017, instituted for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act and Section 3⁄4 of Explosive Substance Act.

It is alleged in the written report that one loaded country made pistol along with three live cartridges has been recovered from possession of the petitioner.

Counsel for the petitioner submits that petitioner was made accused in Nalanda P.S. Case No. 170 of 2017 for the offence under Sections 399 and 402 of the Indian Penal Code with respect to aforesaid occurrence in which he has already been granted bail by the court below. He is in custody in the instant case since 15.12.2017. Counsel for the petitioner further

Patna High Court Cr.Misc. No.69962 of 2018(2) dt.03-12-2018 2/2 submits that co-accused Md. Shahanshah has already been granted bail by coordinate Bench of this Court vide order dated 28.6.2018 passed in Cr. Misc. 31801 of 2018 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Nalanda P.S.
