JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-10-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Forbesganj P.S. Case No. 924 of 2019, registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 337, 338, 379 and 504 of the Indian Penal Code. As per allegation, when the informant and his cousin brother were going to purchase Ayurvedic medicines, some persons caught them and started assaulting them on suspicion that they are

Patna High Court CR. MISC. No.23082 of 2022(2) dt.12-10-2022 2/2 child thieves. Subsequently, 5-7 thousand persons gathered there. On such information, police party reached and took them in custody In the instant case, 51 persons have been named in the FIR as well as 500 unknown persons.

Learned counsel for the petitioners has submitted that the entire allegation is false and on similar footing, some accused persons have been granted anticipatory bail in Cr. Misc. No. 6475 of 2020 and Cr. Misc. No. 8167 of 2020.

Considering the above-mentioned facts and circumstances, and also considering the clean antecedent of the petitioners, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, Dist.-Araria in connection with Forbesganj P.S. Case No. 924 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
