The petitioner in the present case is seeking anticipatory bail in connection with Jainagar P.S. Case No. 563 of 2018 registered for the offences punishable under Sections 379/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that a bare reading of the FIR would show that whole case is based on mere suspicion.
Learned APP has though opposed the prayer for bail but it is apparent on the face of the record that the allegations against the petitioner are based on suspicion, the petitioner has got no criminal antecedent, thus, the Court is willing to extend
Patna High Court CR. MISC. No.22612 of 2019(4) dt.16-07-2019 2/2 the privilege of anticipatory bail.
Let the petitioner above named, in case of her arrest or surrender within four weeks from today in connection with Jainagar P.S. Case No. 563 of 2018, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhubani, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
