Heard learned counsel for the opposite parties. This application has been filed under Section 482 Cr.P.C. for quashing the order dated 24.07.2013 passed in Patna Gandhi Maidan P.S. Case No. 36 of 2011 whereby the learned court below has rejected the prayer of the petitioner and other accused for discharge.

While rejecting the prayer, the learned court below perused the material in the case diary i.e. evidence of the witnesses in paras 3, 4, 5, 6 and 161 of the case diary.

I have also gone through the aforesaid paragraphs and without disclosing the mind on the merit of the case, I am of the view that even a suspicion of commission of offence is sufficient to allow

Patna High Court Cr.Misc. No.45618 of 2013 dt.23-11-2017 2/2 criminal prosecution. Therefore, this Court is not inclined to interfere with the impugned order.
