JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-10-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Maheskhunth P.S. Case No. 50 of 2017 registered for the offence under Sections 366/34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith co-accused Panchanand Singh and 3-4 unknown persons with bad intention used to come to the house of informant and on protest, they threatened to abduct informant's daughter. It is further alleged that when some unknown numbers came on the mobile of informant's daughter, she (informant's daughter) went to lodge a case in police station, but she did not return and as such, the informant suspected that her daughter has been kidnapped by petitioner and his associates.

Patna High Court CR. MISC. No.24512 of 2020(2) dt.01-10-2020 2/2 It is submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated in this case. It is further submitted that other co-accused have already been granted bail by this Court, vide Annexures 2, 3 and 4 respectively. Petitioner has no criminal antecedent. However, considering the nature of allegation against this petitioner, the anticipatory bail application of petitioner is rejected with an observation that if petitioner surrenders before the court below and makes a prayer for regular bail, the learned court below, without being prejudiced with this order, may examine the same and pass appropriate order in accordance with law.
