JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 It is submitted that petitioner no.1, Parmeshwar Prasad has been arrested, hence his application became infructuous. Heard learned counsels for the petitioner and the State. Rest of the petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353, 224, 225 and 504/34 of the Indian Penal Code. It is alleged that when the Officer-in-Charge of Katra police station went to investigate Katra P.S. Case No. 141 of 2014 then accused persons started abusing the persons who were present there and when the informant prohibited to do so, they also abused the informant and scuffled with him when all the family members managed to get Parmeshwar Prasad flee away from the police custody.

Considering the nature of accusation and petitioner nos. 2 to 5 being lady, let the above named petitioner nos. 2 to 5 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Muzaffarpur in connection with Katra P.S. Case No. 143 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
