JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 27.02.2016 in a case registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act. According to prosecution case itself, at the time of alleged occurrence deceased along with F.I.R. named accused, Meena Devi was going by a tempo and two unknown persons intercepted the said tempo and shot fire on the deceased. Furthermore, it is admitted case of the prosecution that petitioner was driving the said tempo at the time of alleged occurrence. The investigation against the petitioner has already been completed. Petitioner does not have any criminal antecedent.

Patna High Court Cr.Misc. No.40496 of 2016 (2) dt.03-10-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Rasalpur) P.S. Case No. 59 of 2016.
