JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 Petitioner prays for bail in connection with Bidupur P.S.Case No. 96 of 2018 registered for the offences punishable under Sections 341, 342, 323, 392, 504 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per FIR is that some miscreants intercepted the informant and snatched Rs.40,000/- from him, who identified the petitioner as one of the accused persons. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case due to money dispute and during investigation the case has been found to be under Sections 386/34 IPC and 27 of the Arms Act and he is in custody for more than three months.

Having heard both sides and in the facts and circumstances, this application is disposed of with the direction to learned court below to verify the criminal antecedent of the petitioner and if he has no criminal antecedent, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur, in connection with Bidupur P.S.Case No. 96 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
