The petitioner seeks bail in connection with Jogbani (Bathnaha) P.S. Case No.177 of 2018, corresponding to Special Case No.14 of 2018 registered under Sections 21, 22, 23 of N.D.P.S. Act.

In the written report, it is alleged that Roshan Kumar and Ricky Kumar were apprehended by the police and from their possession 155 bottle of cough syrup have been recovered. The apprehended person disclosed that recovered cough syrup was provided to them by Nitish Kumar which was to be delivered to petitioner.

Learned counsel for the petitioner submits that the recovery is not made from the conscious possession of the

Patna High Court Cr.Misc. No.73288 of 2018(2) dt.11-12-2018 2/2 petitioner. His name has been taken by the co-accused. Petitioner is having a clean antecedent. He is in custody since 02.08.2018.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge, Araria in connection with Jogbani (Bathnaha) P.S. Case No.177 of 2018, corresponding to Special Case No.14 of 2018.
