JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 379 of the Indian Penal Code.

It is alleged that one unknown lady stole the trolley bag of the informant when the informant was travelling by train. The trolley bag in question contained some articles including cash, documents and certificates.

Learned counsel for the petitioner submits that FIR is against unknown lady. The name of the petitioner has surfaced during investigation. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got no criminal antecedent.

Learned counsel for the State opposes the bail petition

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway, Gaya in connection with Sasaram Rail P.S.
