The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 420, 406, 467, 468, 471, 120B and 504 of the Indian Penal Code.

It is alleged that the informant's father took a LIC policy in the name of the mother of the informant. On the death of the mother of the informant the father of the informant being nominee in LIC policy claimed the insurance amount. Subsequently the father of the informant also died. When Manoj Yadav and Mahmood Alam being the agents of the LIC tried to get insurance claim encashed through the account of the father

Patna High Court Cr.Misc. No.529 of 2015 (03) dt.30-01-2015 2/2 of the informant by affixing the photograph of the petitioner in place of the father of the informant.

It is submitted by learned counsel for the petitioner that admittedly the cheque was not encashed and this is not in dispute that on none of the documents bear any signature of the petitioner when Manoj Yadav has been granted anticipatory bail by the learned court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against Manoj Yadav and Mahmood Alam, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 320 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
