Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Tajpur (Halai) P.S. Case No.233 of 2019, registered for offence punishable under Sections 147, 323, 341, 354, 504, 506 of the Indian Penal Code and Sections 8, 10, 12 of the POCSO Act.

As per the allegation, the minor daughter of the informant went to her school where co-accused Rupesh Kumar, Sachin Kumar and Pinku Kumar forcibly caught her and coaccused Rupesh Kumar, put vermilion on her forehead when the informant went to complain the matter to the present petitioner, who is father of Rupesh Kumar, he abused him and also

Learned counsel for the petitioner has submitted that the main allegation is against Rupesh Kumar, Sachin Kumar and Pinku Kumar and not against the present petitioner. He has been implicated since he is the father of co-accused Rupesh Kumar. The petitioner is the person of clean antecedent. Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned VIth Additional Sessions Judge-cum-Special Judge, POCSO Act, Samastipur in connection with Tajpur (Halai) P.S. Case No. 233 of 2019, subject to condition as laid down under Section 438 (2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
