1. It is reported by Shri Prasoon Sinha, the Learned counsel for the appellants that the appeal was preferred against the judgment dated 26.02.2004, passed by the Learned 5th Addl. Sessions Judge, Muzaffarpur in Sessions Trial No. 378 of 1996, wherein the appellants, namely, Hari Nandan Das and Shankar Das are convicted and sentenced to undergo rigorous imprisonment for ten years for the offence under Section 304(ii), read with Section 34 of the Indian Penal Code and further to undergo rigorous imprisonment for two years for the offence punishable under Section 324 read with Section 34 of the Indian Penal Code.

2. It is further reported by the Learned counsel for the appellants that the appellants were not enlarged on bail during the pendency of the appeal and they have underwent the punishment for the period of ten years. Further, it is reported by the Learned counsel for the appellant that they had already undergone the sentence and were released from the prison. Nothing remains in the appeal against these two appellants, namely, Hari Nandan Das and Shankar Das, for adjudication.

3. Therefore, the criminal appeal is dismissed/closed.
