JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Mufassil P.S. Case No. 138 of 2016 for the offences instituted under Sections 498(A), 365/34, 304(B), 120(B) of the IPC and 3⁄4 of the D.P. Act.

The accusation is of torture inflicted by the accused persons to the informant's sister due to non-fulfilment of dowry demand. For that a Panchayati was fixed on 18.03.2016 but on that date when the informant alongwith Panches and others went there, the in-laws of his sister were not present in the house. He learnt from the villagers that his sister's husband Tunnu Yadav took her

Patna High Court Cr.Misc. No.21411 of 2017 (2) dt.23-05-2017 2/2 on his bicycle and since then she is traceless. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioner no. 1 is the brother-in-law (Bhaisur) of the deceased and petitioner no. 2 is the brother-in-law (Sala) of petitioner no. 1. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Mufassil P.S. Case No. 138/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
