In this case, the petitioner is seeking anticipatory bail in connection with Brahmpur (Krishnabrahm) P.S. Case No. 39 of 2019, registered for the offence punishable under Section 30(a) and (c) of the Bihar Prohibition and Excise Act, 2016. On a secret informant, the Police party arrived near the petrol pump at Udiyanganj Bal situated at village Noniyarpur, where a truck, a tempo and one motorcycle were parked. Upon seeking the Police party, the accused persons fled away from there taking the advantage of darkness. Upon search, huge quantity of liquor has been recovered from the said vehicles. This petitioner has been identified by the Choukidar. Learned counsel for the petitioner submits that the

No.20889 of 2019(2) dt.04-04-2019 2/2 petitioner has gone to hospital in connection with delivery matter of his Bhabhi, while returning, someone was following, so he left the vehicle and fled away from there. The ground taken by learned counsel for the petitioner does not inspire any confidence. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
