JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-03-2022 Heard Mr. Rajendra Narain, learned senior counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Fulkaha P.S. Case No. 142/2020 registered for the offence punishable under Sections 302, 379 and 120(B)/34 of the Indian Penal Code 1860.

The allegation, as per the First Information Report, is that co-accused Tuniya @ Tuniya Devi, who is the step motherin-law of the informant, allegedly killed the grand mother-inlaw of the informant due to land dispute with the help of her criminal associate.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and

Patna High Court CR. MISC. No.33240 of 2021(4) dt.07-03-2022 2/3 Tuniya @ Tuniya Devi who allegedly in connivance and association with the petitioner and others has got her step grandmother-in-law killed has been granted bail by this Court in Cr. Misc. 30941 of 2021.

On the other hand learned counsel for the State submits that for a brief period of three months, talk had taken place on Mobile between the petitioner and co-accused Tuniya @ Tuniya Devi and location of the Mobile of the petitioner was found near the place of occurrence.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that co-accused Tuniya @ Tuniya Devi has been granted bail by this Court and further the petitioner has been made accused on the basis of confessional statement of co-accused Tuniya Devi and only material which has come that there was a talk on the date of occurrence between the petitioner and coaccused Tuniya Devi, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the
