The petitioner is languishing in custody for the offences punishable under Sections 147, 148, 149, 307, 302, 121A, 452, 504 of the Indian Penal Code, Section 27 of the Arms Act and Section 16, 17, 18, 19, 20, 21, 22 of the U.A.P. Act.
According to FIR, the petitioner is assailant of the deceased. Informant Tukan Yadav claims to be eye witness of the occurrence, however, during trial Tukan Yadav was examined as PW 3 and stated that on the order of Sanjay Yadav, co-accused Jeet Lal Yadav had caused fire arm injury and death of his son Heman Yadav.
Considering the statement of the informant during trial, let the petitioner, above named, be released on bail on
Patna High Court CR. MISC. No.76779 of 2018(5) dt.12-04-2019 2/2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S. Tr. No. 53 of 2018 arising out of Sono (Charkapathar) P.S. Case No. 146 of 2016 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
