JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-08-2022 Heard learned counsel for the petitioners and learned A.P.P for the State through video conferencing. The petitioners apprehend their arrest in Dinara (Bhanas) P.S. Case No. 341 of 2020, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2018. 03 litres of country made liquor and 15 litres of Mahua solution has been recovered from the house of petitioner no.2 and petitioner no. 1 is wife of petitioner no. 2. It is submitted that nothing has been recovered from conscious possession of petitioners. Though, in the FIR it is alleged that illicit liquor has been recovered from the house of

Patna High Court CR. MISC. No.22888 of 2022(3) dt.26-08-2022 2/2 petitioner no. 2, but as per the seizure list recovery has been shown from the house of co-accused Shyam Bihari Ram. Petitioners claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd-cumSpecial Judge, Excise-I, Rohtas at Sasaram in connection with Dinara (Bhanas) P.S. Case No. 341 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
