The petitioner is apprehending his arrest in connection with Agamkuan P.S.Case No.168 of 2018 registered for offences punishable under Sections -30(A), 37(1) of the Excise Act. As per the FIR, there is recovery of 10 ltrs. of liquor from the house of the petitioner.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no criminal antecedent.

Heard learned A.P.P. , who has opposed the prayer for bail..

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of

Patna High Court CR. MISC. No.29510 of 2019(5) dt.18-10-2019 2/2 with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid direction, this application is dismissed.
