Heard learned counsel for the petitioner as well as learned APP for the State assisted by learned counsel for the informant.
The petitioner apprehends his arrest for the offences alleged under Sections 302/34 IPC registered in connection with Kudhani (Fakuli O.P.) P.S. Case No.257 of 2020. As per allegation, the accused persons named in the FIR badly assaulted the deceased. The allegation against the petitioner is that he inflicted sword blow on the head of the deceased. The deceased as per postmortem report sustained injuries on his head.
Learned counsel for the petitioner has submitted that

No.31905 of 2021(2) dt.24-03-2022 2/2 the informant has stated that the present petitioner has inflicted sword blow on his head whereas his wife has stated that coaccused Ganaur Rai has inflicted lathi blow on the deceased. There is specific allegation that the present petitioner inflicted sword blow on the head of the deceased. As such, it is not a fit case for anticipatory bail. Hence, it is rejected. Office shall ensure that all the defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
