Mr. Shyameshwar Dayal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-10-2022 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 354(B), 326, 379, 307, 448, 504 and 506 of the Indian Penal Code and Sections 3/ 4 of the Dayan Act. Allegedly, it is a case of assault upon the informant and her family members and also members of the petitioners side called her mother-in-law as Dayan.
It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.23291 of 2022(2) dt.10-10-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injuries, as alleged, in separate occurrence. He further submits that the injuries are simple in nature as opined by the doctor. Petitioners have clean antecedent. He further submits that good sense has prevailed between the parties.
Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SDJM, Raxaul at Motihari, East Champaran in connection with Chahuradano P.S. Case No. 171 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
